BEAUTIFUL TOILETS - Beautiful Toilets and Remarkable Toilets are brands of The Remarkable Toilet Company Ltd, Edge Hall, Edge, Cheshire, SY14 8LE, 01948-820300, [email protected] UK LAW - These terms and conditions and any contract formed are subject to UK law and shall be dealt with under the UK legal system only. In these Terms and Conditions the term ‘the Company’ means the Remarkable Toilet Company Ltd, ‘Purchaser’ refers to the purchaser of any goods or services and the term ‘goods’ refers to any item sold by the company. Nothing herein referred to shall be deemed to have construed a relationship with any supplier or purchaser of the Company’s products or services without the express written permission of the Remarkable Toilet Company. COPYRIGHT - All text, graphics, formatting or other materials present on the Company’s web site or in the Company’s printed material shall remain the property of the Company. Harassment in any manner or form on the site, including via email, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Remarkable Toilet Company Ltd, or other licensed employee, host, or representative, as well as other members or visitors on the site, is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libellous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offence, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organisation. The Company will make best endeavours to ensure that any information on the Web Site is correct. If there appears to be inconsistent information on the Web Site this should be brought to the Company’s attention for clarification. THIRD-PARTY LINKS - In an attempt to provide increased value to our visitors, the Company may link to sites operated by third parties. However, even if the third party is affiliated with the Company, the Company has no control over these linked sites, all of which have separate privacy and data collection practices, independent of the Company. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, the Company seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work). SECURITY - The Company endeavours at all times to adhere to best practice in respect of security. The Company bears no responsibility for any security breaches howsoever caused; however, it will act to the best of its ability to see that such breaches do not occur and to remedy such a breach in the unlikely event of it occurring. For web-based orders we use a secure processing system (WorldPay) utilising Secure Socket Layer (SSL) technology. All credit card numbers are encrypted in the software and the Company holds no credit card details after the order has been successfully placed.
2 Pre-Sales
PRICING - Where pricing is shown on the web site or in the Company’s literature, unless stated otherwise, this is inclusive of Value Added Tax (VAT) where applicable, charged at the prevalent UK rate, currently 20%. OWNERSHIP OF GOODS - All goods shall remain the property of the Company until paid for in full. No financial offset against the value of goods supplied is permitted for whatever reason without the written agreement of the Company. DIMENSIONS - Dimensions of the Company's products can vary slightly. We strongly advise that you position your products before installing any pipework. The Company will not be liable for any damage or losses incurred by the purchaser or their representatives for installation of pipework prior to the goods being placed in situ. If the dimensions of any product are of critical importance, the Company should be consulted prior to purchase. PLUMBERS - We strongly advise that plumbers are not booked until your products are on site. The Company will not be liable for any damage or losses incurred by the purchaser or their representatives for the booking of plumbers prior to the goods being placed in situ. Where supplied, if our installation instructions are not followed it will invalidate your guarantee. REGLAZING – For reglazed goods, the Company gives no guarantee that the colour will accord precisely with the advertised colour and the Purchaser accepts that there may be differences. Please note that colour shades/finishes may vary over time. Colours/finishes presented online will vary between different computers and monitors; therefore, the colour/finish and gloss level must be used only as a guide. Please note that goods supplied by the Purchaser for reglazing are reglazed at the Purchaser’s risk. Should a flaw or fracture develop in the kiln, the responsibility for the provision of replacement goods lies with the Purchaser. PAINTING & ELECTROPLATING - For painted & replated goods, the Company gives no guarantee that the colour will accord precisely with the advertised colour and the Purchaser accepts that there may be differences. Please note that colour shades/finishes may vary over time. Colours/finishes presented online will vary between different computers and monitors; therefore, the colour/finish and gloss level must be used only as a guide. Electroplated and polished finishes are natural, living finishes and the colour may therefore change over time. RIGHT OF SUBSTITUTION - The Company reserves the right to substitute equivalent goods should it deem necessary. All specifications are approximate and the Company shall have no liability in respect of reasonable deviations from those specifications. It also reserves the right to vary the specification of supplied goods and all goods are sold subject to the prices and terms and conditions ruling at the time of delivery.

INVOICE - It is the responsibility of the Purchaser to check their invoice and ensure that all details on the invoice are correct. The Company will not be held liable for any details that are incorrect if they have not been brought to the attention of the Company prior to the dispatch of goods. PAYMENT - Payment for goods is in full in advance at the point of order unless with the prior agreement of the Company in writing. Where goods are provided under a trade price, the Company must see copies of headed notepaper together with a company registration number before goods are supplied. If such items are not provided to the Company, it reserves the right to charge for the goods at the prevalent retail price. DELIVERY - Delivery dates are approximate and no liability is accepted in respect of late deliveries. Upon request we supply estimated delivery dates. Purchasers are notified of confirmed delivery dates prior to dispatch. The Company will not be responsible for any delays in the delivery of goods or services, nor for any damages or loss caused to the Purchaser, or other party, as a consequence of this delay. The Company will endeavour to meet any special shipping requirements as a courtesy, but will not be held responsible for failure to meet these requirements. SHIPPING - Small items will be shipped either by courier or Royal Mail delivery. Larger items will be shipped by a pallet forwarding network using a HGV. When shipped using this method the haulage company will attempt to deliver pallets as close as possible to the Purchaser’s required position, usually to the closest hard-standing area. The haulage company is under no obligation to remove items from the pallet, nor carry items into the Purchaser’s property. The Purchaser should warn the Company if there is restricted access, soft, or gravelled driveways. Should the Company not be notified in advance of any restrictions in delivery access, or should the Purchaser or their representatives not be present to sign for the goods, the Company reserves the right to charge a redelivery fee. Please ensure that sufficient manpower is available to unpack the pallet once unloaded. For timed, and/or Saturday deliveries, the haulage company levies additional charges, please contact the Company for details of these charges. The Company will not be held responsible for any failure of the haulage company, courier, or Royal Mail, to deliver within the specified period, or at the specified time. ACCEPTANCE OF DELIVERIES - Please ensure that goods are unpacked when they are delivered and checked against the delivery note. If they are not checked fully upon delivery, the delivery note should be signed as ‘condition unchecked’. When signed as ‘condition unchecked’ any goods damaged in transit, or unsatisfactory goods, must be reported to us within 24 hours of delivery. The Company will not be held liable for any damaged, missing or unsatisfactory goods not reported to us within this 24 hour time period. The Company can take no responsibility for damaged goods signed as being in good condition and cannot be held responsible for any damage occurring after delivery. If delivery is refused, the cost of delivery and return shipping will be deducted from any refund due under our returns policy. If delivery is refused and the item is received back damaged, no refund will be payable for the item. INTERNATIONAL DELIVERIES – International customers are responsible for: 1) checking the delivery progress of their order once a tracking code has been supplied by the Company; 2) settling any import taxes and/or VAT due in their own country; and 3) arranging for redelivery/collection where delivery has been attempted and the customer is not present. Where items are returned to the UK because of either a) non-payment of duty/VAT; b) refusal to accept a delivery; or c) the items have not been claimed from the delivery company, the cost of delivery and return shipping will be deducted from any refund due under our returns policy and should the item be received back damaged, no refund will be payable for the item. INSTALLATION - Your plumber must be qualified to accepted UK standards, such as a plumber who is certified by NVQ (National Vocational Qualification) or SNVQ (Scottish National Vocational Qualification) Level 3. Failure to use a suitably qualified plumber will void your guarantee. BACK ORDERS - Should any item requested by the Purchaser be on back order, the Company will endeavour to supply such goods as soon as possible; however, the Company will not be responsible for any delays in the delivery of goods or services, nor for any damages or loss caused to the Purchaser, or other party, as a consequence of this delay. If an item or item(s) are on back order, the Company reserves the right to deliver partial orders in advance of completion of the whole order. FORCE MAJEURE - No responsibility can be accepted by the Company for any failure or delay in performance which is wholly or partially due to an Act of God, War, Fire, Explosion, Riot, Civil Commotion, Restriction by Government or other competent authority, Strikes, Lock Outs, Pandemic, Failure in Supplies, or to any cause whatsoever beyond its control.
4 Post-Sales
GUARANTEE CONDITIONS - The Company will replace any product found faulty due to manufacturing, or workmanship, free of charge within the guarantee period, subject to the following conditions: • The product must have been installed within four weeks of receiving the product; • The defect is not due to wear and tear, accident, misuse, improper operation or failure due to incorrect installation; • Any item arriving cosmetically damaged will be replaced free of charge, as long as it is reported to the Company within 24 hours of receipt. The Company will not replace items reported as cosmetically damaged after 24 hours of being received. • The cost of labour is paid by the Purchaser; • Proof of purchase is available; • The Company is not liable for any consequential loss caused directly or indirectly by any defect in its goods; • The benefit of this warranty is given to the first purchaser of the goods and is not assignable. CAST IRON BATHS GUARANTEE - The Company will replace any cast iron bath found faulty due to manufacturing, or workmanship, free of charge within a 10 year period, subject to the above guarantee conditions. STORAGE AND COLLECTION OF GOODS - The Company upon request will consider the storage of customer orders for a limited amount of time. Should goods not be collected within one month, the Company shall be entitled to charge storage at £5 per pallet per week. Any goods not collected within a six month period will be disposed of. CANCELLATION AND RETURNS POLICY - The Company will accept the cancellation or return of non-faulty goods within 30 days as long as the goods, including their manufacturer’s packaging, are fit for purpose and in the same condition that they left its warehouse. For hygiene reasons we cannot accept the return of toilet seats unless they remain sealed in their original internal packaging. Upon the return of such goods in the aforementioned condition a full refund of the item price excluding postage and packaging will be given within 30 days, subject to a 20% restocking charge and the cost of returning the goods to the warehouse. Bespoke goods, i.e. those created, assembled, painted, reglazed, replated or polished to a purchaser’s requirements cannot be cancelled without full charge. COMPLAINTS - The Company prides itself on the provision of first rate customer service; however, in the unlikely event that you do have a complaint, such a complaint must be furnished to the Company in writing within 7 days of the receipt of goods setting out the grounds of complaint. The Company will ensure that any such complaint is dealt with sensitively and in a timely fashion.
